Personally, I don't think anyone should have or be given access to any persons private email living or dead. It sets a bad precedent, that once made exception for, there is little to stop ex-wives for example gaining access to a spousal email account in order to prove infidelity or some such. Lawyers can twist anything. PRIVATE means PRIVATE. My 2 cents.
