What are the rules/regulations that go along with the sale of OEM operating systems? Do OEM operating systems have to be sold with a computer, or can they be sold with just any piece of hardware?

some places will count a back cover screw as a piece of hardware,

the intention was for it to be a motherboard or a harddrive

check with the dealer for the requriments they have

Actually I wanted to know because I have a OEM copy of Windows 98 that I wanted to try and sell on the forum. Does PCMECH have any requirements concerning the sale of OEM software that I should know about?

Software is a wildcard. OEM's are intended to be only with New BUILDs, that is why they requirement to sell OEM's has been major computer parts Like Motherboard and hard drives. Mainly Here at PCMECH, we won't allow trades of Copied Software, example burned CD's. Any Software that is traded at PCMECH is suppose to include the the Licience, in the case of an OEM OS, it would have to include the Key code, of course you would have to give up all rights to it, uninstall it from your machine. It is the sellers responibility to make sure the EULA is not broken. I am not going to pretend to be an expert on this subject. Use caution and common sense and don't do anything that might appear out of line and I believe you will be fine.

If this is a generic OEM windows package, you can legally sell it if you have removed it from the computer that it was sold with or originally installed on. If it's a recovery CD or if the book has a sticker on the cover that says "Only to be sold with a (fill in the brand) computer", sorry, that's a EULA violation.
