Frame Rate stuck at 31, why!?

I play MS's Links 2003 Championship Edition, and I can't figure out this thing.
No matter what I do with the rig, the frame rate wouldn't go up above 31 for long, why is this? So far I've tried videocard.text thing to no avail, tried all kinds of resolution settings, tried different drivers, set options differently, even tried overclocking the videocard using RivaTuner, and RAM timing in BIOS. I should get around 50 FPS with my rig I would think. Another problem, IT CRASHES within playing a single round. My hardware is spanking new and videocard works perfectly outside the game, so I'm totally lost. Any ideas of raising the frame rate as well as eliminating crashes?

The game has a mechanism of locking your frame rate. There is a hack, to enable it. If I could find it. Its just the same as in C7C generals.
Better use coolbits as well as riva tuner

I believe it's "V-Sync" that does that. It is found in many games. If you can find V-Sync in the options menu disable it and see what happens.
