Can I legally sell this?
Almost a year ago I bought an OEM copy from newegg of Windows XP MEdia center edition 2005. I used it for about a year and then upgraded my PC to Vista, so the XP is not installed on a computer anymore but it was activated on the computer I had it on.
Can I now sell it to someone else, or is that not an option? The COA is still with the CDs in their case. |

"Legally" OEM versions can't be transfered....

In my experience, software licenses are non-transferable (OEM or not)

Legally, OEM versions of Windows may not be transferred without the computer but retail versions may be resold once.

I originally thought of this as a joke, but now I'm seriously wondering.
the computer that it was activated on had it's motherboard/cpu changed when I upgraded the windows to vista. So what if I sold the cds along with the motherboard and cpu they are activated on, and then the buyer can choose to re-activate the windows on a diff PC if they wish, or they can use it with the old mobo/cpu (which wouldn't require a re-activation) ? That's a gray area. There's more to triggering a reactivation than just the motherboard and CPU. If your Vista is an upgrade, not OEM or full retail, you legally must keep that copy of XP.

the vista is not upgrade, it is a full student version I got from my university.
I thought that microsoft decided the motherboard was the "unswappable" piece of hardware that windows sort of locks onto (meaning you can change out your memory, hard drive, dvd rw drive, and case and it won't know the difference while it's still on the same mobo.) |

Speaking of OEM's, I was thinking of buying an OEM copy of vista ultimate. My question is in like 3~4 years when i upgrade/buy a new pc , will i also have to buy a new copy?
