this is slightly a rant and slightly a question on laws.
i have had videos on youtube for years i believe the first upload of mine was uploaded august 2005. only recently most of my videos including that first one have been silenced because i used a song that some big record company claimed. seriously the video has been up for 4 years and youre going to come along and take it off?! in all of my videos which are videos of gameplay i have in the credits a section for music where i give credit to the band and give the name of the song. i used to understand the copyright laws and the sale or distribution of protected item in this case songs. now, i have never once received payment in anyway for useing, and in many cases promoting (people ask "hey who sings this" usually i reply "its in the credits at the end"), those songs. and for distribution last i knew you had to keep a physical copy to have been considered to recieve a product. the only person who i "distributed" to would be youtube's servers. i dont know the law by heart but i as a musician believe that this is nothing more than greedy record companies whining about technology that enables the end user to rip the music that they bought into a digital form and use it on a video for the wold to see. if i make a video and someone asks me for info on the band, the damn record company just recieved a new customer. I AM FREE ADVERTISEMENT! let us post music on youtube. gameplay videos would be boring without music. and they suck when i have to pick some BS song from youtube's list. the way the videos are originally designed they go along with the music. that i chose to go with the video. maybe there should be rules about crediting the song. but there arent if you use the song they simply punish you. THEY DONT EVEN USE PEOPLE TO DETERMINE THE INFRINGEMENT! they have a crawler that goes around and matches the song to a database and instantly delete it. i seriously have a problem with the greed these companies have, im willing to be this system is directly credited to a lawsuit. as a musician i do not agree with this we do the work but the music doesnt belong to the bands. im not famous or in a big band but the music should belong to the people who wrote it and whoever they want to have it. i would love for someone to use a song i wrote or helped write in a video because its free promotion, i just wish the labels could see that. and i want my OLD videos to have their music back. people liked the videos when they were the way i made them now they are terrible and boring. is there ANY way i can convince youtube to fix my videos? a movie is nothing without a soundtrack. -redstorm |

That's pretty unfortunate. I know I've discovered some pretty cool music in gaming videos. |

not only does it remove the music but it also removes the game sounds which in itself ruins the video. i understand they cant just go and take out that one song. so thats another reason to keep the music in the first place.

If you have permission from the artist or if it's under the creative commons license, you can get it reinstated.
Otherwise, since you don't own it, yes, when and if youtube finds it, it will be disabled.

the problem is the band its self doesnt even own the rights to the song. its all the record company. im just saying there should be rules about giving proper credit like citing a source in a paper.

Doesn't matter.
Citing a written work is not the same as including a clip of music and saying what it is. The equivalent would just be to list the citation information of the song. On the other hand, if you photocopied a few pages from a book, included them in your document, and added a citation, you would probably face a bit of trouble from that (the equivalent of what you were doing with the music) The problem is reproducing the work without proper permission. By making them available publicly (ie, youtube), you are effectively reproducing the work without permission, which is why youtube took the action it did. |

In the UK if that wanted to get pedantic with you, you could possibly find yourself being prosecuted for public broadcasting without a licence.

I don't blame Google (parent company of YouTube) for trying to avoid the lawsuits. Besides, its illegal if you do not get the owners permission.

Getting permission means you will have to pay for it. Commercial establishments have to pay for their music.
