I'm no law scholar, but I did find this case from 1977, Ingraham vs. Wright, that found that corporal punishment does not violate the 8th amendment and corporal punishment is not cruel and unusual.

I search for Supreme Court decisions at http://nt.scbbs.com/cgi-bin/om_isapi...USSC_srchframe. It is quite useful.

yea, and the parents take their kids to shrinks and stuff without even disiplining them, and they say "we've tried nothing, and we're all out of ideas"
i'm glad my parents had some sense and disciplined me and my brothers when we screwed up.

i didn't say like beat the kids or anything, but teach them what's right and wrong. a lot of people i went to high school with had no concept of this. it's actually pretty scary.

My God...you are scary....you called the cops? On your parents? The ones that brought you to life? Man, what are you? Some sort of jerk? Perhaps God didn't give you a brain? Or perhaps your just a retard? My God...calling the cops on your parents.

hey man, that's not cool. i mean, i don't agree with calling the cops on someone's parents either, especially since they're trying to raise you right and they just spanked you, but you don't need to flame him up like that.

If you rat out your own parents you deserve foster care.

"...and technically spanking anyone is assult."

That is a legal conclusion that is incorrect.

Also, getting back to your narrow call of the question, the issue is not whether the U.S. Supreme Court ever banned corporal punishment (they never did btw), but rather the issue is whether the Court will step in and help your School when they are sued for battery. The answer is no. That does not mean corporal punishment is legal or not legal, banned or not banned. It means schools just don't want the lawsuits.

That's why corporal punishment is rare nowdays.

This thread has evolved into a touchy subject that we really don't want to go into any more here. Please take any further discussions on subjects like this over to Forumclick. I have some pretty strong opinions about some of the things that have been said here myself, and am not even going to go there.

Sauron: I can see you have some pretty strong feelings too, but that doesn't give you the right to flame anyone here for any reason.

Thread is closed because it appears the original question has been answered by a lawyer and the poster has acknowledged it.
