Westell 327W Bricked?

I got Verizon DSL about 5 months ago. Started having issues from the begining, old outside wires. I noticed that when they claimed they had fixed it, my firmware on my modem had been updated. Did some research and found the old firmware. I then updated the firmware to the old one (not sure on the numbers, 4.04 down to 3.02 ?). About two weeks ago, had a rain storm and lost internet. Called Verizon again, they checked connectivity and what ever else they do. Said they would send a tech out. The next day I noticed my firmware was updated again. Didn't get a chance to downgrade until last night. I used the same exact file I used 2 months early (I keep all program files and .exe's). Firmware update failed after 3 attempts. Rebooted the modem and the DSL light come on red or orange (cant tell, depends on the angle you look). Tried to get into the modem and got site cant be found and no ip. So I called Verizon, and they denied updated the firmware. The tech told me I need to buy a new modem. This is not right, they updated my firmware without permission and now I believe it is bricked. Is there anything I can do with the modem to fix it?

What was wrong with the new firmware? Why did you keep backflashing it?

If the modem is only 5 months old, it should be on warranty.

Did not like the new firmware. Hard to navigate. The modem was from a previous contract with Verizon, so it is out of warranty.
