Why is it when someone is downloading from my webserver or Fserve in IRC it only downloads at the MAX speed of 12kps? Or is this a standard for DSL?

They are downloading at your UPLOAD speed cap. Think about it for a minute.
The cap is there for a reason - to discourage you from running servers on a residential account. You can get a symmetric BUSINESS account to run servers, and pay accordingly. |

In addition, both DSL and cable networks are designed to have more download bandwidth than upload bandwidth, because that's the model for most usage.
