Can I use this version of xp pro for my new build?

They say it's legal for commercial use.

You should have no problem, however Microsoft might make activation of the product difficult. You might have to send proof that you are a student or teacher.

The guy is using a private PO box as his address. He has no rating at resellerratings and appears to be selling that version outside of the authorized distribution channels. His page doesn't check for your eligibility to purchase that version either. 2nd link from bottom on this page shows that address as "International Mail Forwarding Network".

Thanks guys, yeah I also checked him out on resellerrating. Not good. One question though, don't all oem software products allow only one activation?

For the same price you could get XP Home OEM from Newegg.

Neither OEM or Retail have a limitation on activations. They both work the same.

You can reactivate them more than once, you just can't use the same liscense on more than 1 computer at a time.
