How to legally sell windows xp

I know someone that installed a windows xp upgrade from windows me and has had nothing but problems since. If he wants to go back to me or try installing an oem xp, how would he go about selling his xp ugrade? it has already been activated.

I know it could probably get about $50 on ebay, but it seems like the buyer would have a problem activating it if it were already activated on another computer.

If it was a retail upgrade, he can transfer the license to anyone he sees fit. All Media, documentation etc. must be given to the new owner, and the trensferree must agree to abide by the terms of the EULA. Other than that, go for it.

Cool

He can do a clean install with the upgrade CD if he has a full version of WIN ME or 98. Just boot up with XP CD and at some point in the install it will ask for a qualifying OS. Put in the WIN ME CD for verifaction and then XP will continue to load.

Thats what I did with mine. Put int he 98 cd, said put in xp cd, installed xp.

That's exactly right. ALthough the EULA can technically be transfered, the issue is that the product has already been activated. The activation key would no longer work for the new buyer. M$ is very tight about this -- they will not issue a new EULA+activation key without verification the old one is no longer being used.

The best thing your friend can do is use the upgrade CD to do a clean install. It will then ask for proof of ownership for either Win98, WinME o Win2000.

Ownership of a prior version doesn't suffice. I installed XP Home from an upgrade disk and had to activate anyway.

I never actually read the license - see if it permits you to sell. If so, then the purchaser should be able to convince MS to activate his copy by whatever MS deems an acceptable proof of purchase.

Did you register your copy of XP? If not, then theoretically MS doesn't know who installed it. They'll just know that the new installation doesn't match the original hardware. Since they say they will grant activation if you move XP from one machine to another, how will they know if you move it from your machine to your friend's, and furthermore why should they care - it's a one machine license and it's only being used on one machine.

It doesnt really matter if you have to activate it, A call to M$ with the pertinent information will result in a new activation code. The EULA allows for transfer so they have to do it.

From the EULA:

TRANSFER-Internal. You may move the Product to a different
Workstation Computer. After the transfer, you must
completely remove the Product from the former Workstation
Computer. Transfer to Third Party. The initial user of the
Product may make a one-time transfer of the Product to
another end user. The transfer has to include all
component parts, media, printed materials, this EULA, and
if applicable, the Certificate of Authenticity. The
transfer may not be an indirect transfer, such as a
consignment. Prior to the transfer, the end user receiving
the transferred Product must agree to all the EULA terms.
No Rental. You may not rent, lease, lend or provide
commercial hosting services to third parties with the
Product.

reedimus what kind of trouble did he have i also upgrade from me to xp ,also has all some trouble i download that servicepark 1 from msn ,and now it works just fine and has for two weeks now.

Burl, Often there are either software or hardware incompatibility problems that exist with XP or any OS for that matter and the end user does not want to upgrade his/her hardware or software to become compatible with the OS. Reedimus’s friend may have fallen into one of these two categories. Not all problems can be fixed by XP SP-1.

Or the OS may not have lived up to users expectations.

I'm don't know what kind of problems he's having. I'm going to check it out pretty soon, I'll be sure to see if he has the service pack 1.

I, also, did the "upgrade" from ME to XP. Nothing but trouble. Then I reformatted and did a "clean install" of XP. No trouble.

The story about you can only activate your Windows once is bull****. My dad has XP Home and he has it installed on 2 harddisks. He just called twice to the M$ computer phone-line and got the right activation key.

The thing is: every time you run the activation program, XP will give you a random code. The chance that the code you get on screen is already activated is minimal....

Upgrades from an earlier OS will mess up quite a few applications, because their settings are for 98 or ME or whatever....
Clean installs are the best way to go.
