Ok I have 2 computers. One I just bought and it has Windows XP on it. The other one I bought about 4 years ago and it came with Windows 98. Is it against the law to use the Windows XP disk that came with with one computer to upgrade the other computer from Windows 98 to Windows XP?

Yes, and the product activation won't allow you to do it anyway.
